    Andrew what you say has some basis had the engne not been opened. Given that there have been repairs done due to overheating (assuming all that is substantiated etc) then there is an indication that the repair was not done thoroughly or went deep enough. There is a big difference between buying a car that has done 300,000km with a standard untouched by human hands engine and another that has been rebuilt after an incident. The expectation to me is that the rebuilt engine has some additional life.

      That is certainly one of the grey areas, but playing devils advocate and taking the dealers side for a minute, I would question whether the service was done correctly? Was this related to the repairs done or a different problem?

      Lots of grey areas, like most of these situations those of us not directly involved probably don't have enough facts to make any definitive statement on what's fair or not.

        I should add I'm not making any judgement on this particular case, just that the whole take em to court attitude doesn't sit we'll with me, there is always 2 sides to look at this from.

        I agree it's a grey area, but the business has to offer a good product. 4 months is not a good product. After a year? Yes, maybe bad luck.

          HI Andrew

          I agree with you that i ran the risk when i bought a second hand vehicle. However i also undestand that the motor has been rebuilt and that i was then sold the vehicle. I have currently footing the bill for the engine work to be done, however i would expect that the job should have been done properly and correctly and that the engine should last more than 11,000 after being rebuilt.

          Im only looking at options with regards to acc and legal action doesn't mean ill actually use it.

          When purchased i was confident that the engine would last and i fixed up other things as needed IE suspension and other minor issues.

          As i say to clients (I work in IT) its technology some get good runs some don't.

            I know here in NSW you get 5k or 3 months on the warranty but if over 160k or 10 years then they don't have to offer you nothing, on a commercial vehicle they don't even have to offer you that. Here it would be a good will gesture for them to fix it but most would say see you later, that's here in NSW. It may be a different issue in regards to the motor just having work on it I'm not sure, I would do as suggested above and find out how you go about it and if you have a leg to stand on, Good luck either way.....Cheers Steve
