  • Toyota Compensation

    So after having to put a new engine in my Prado after it terminated a few months ago, ive decided to try and get some compensation from Toyota for my costs. Have already contacted Toyota directly and threatened civil action, however they didnt want any part of it. Now am deciding whether to continue with VCAT, which is expensive. Has anyone been successful going through this process?

    Hi,

    I did the same with another car manufacturer. My case was bullet proof and they settled out of court the day before the case. This was sometime ago and not sure of the rules now. However at the time if the claim was under $10k, which it was, no lawyers allowed and it cost me $35 to register my claim. My claim was only $1500, but it was the principal behind the lack of care and no responsibility

    Book a date with vcat. Make sure you have all correspondence emails, note phone conversations, dates, time, who you spoke to, any call centre ref nose, who U spoke to on the call centre etc etc. package this all together in chronological order and mail to them registered mail. include dates of vat. keep a copy for yourself and also mail a copy to vcat so they have all info before the day.

      VCat is cheap.
      If you over 10k it might be $300ish.
      Depends how your case is?

      Many have won in cat, the blow by.
      Not injectors so much.
      Blow by is simple, it's TOYOTAS own schedule is to remove the injectors every 40,000k, while checking valve clearances.
      If they did it, it would have the revised seats and there would have been zero of these issues caused by copper seats leaking.
      Well the cracked piston not so simple.
      But, how long should an engine be reasonably expected to last?
      It should be fit for purpose! Is it? Was it?
      Well why have they changed the pistons to make them more robust?
      Why have the changed injectors to prevent wrong combustion?
      Ask a FAIR person to answer that & you also have a damn good case.
      But never 100% till the day.
      Get your facts clear & get in there.

          That was the road I took when my '06 1KD-FTV grenaded for a second time.

          Though an independent report helped my cause, I'd say simple process - but spent 2 hours on phone and about 5 weeks of mucking around.

          But allowed me to get current Prado.

            Hi
            Have not gone through insurance, not sure it will really work. I think i may go to VCAT, i think all up should cost under a thousand dollars but am asking for $18,000 as compensation so if successful will be justified. I do feel i have a good case, and have also spoke to a soliciter who also said it is a strong case. Just very daunting. After speaking to Toyota first, and them saying they couldnt help was obviously a tactic to scare me off. Will keep you updated.

              They all play the game of not helping. I took Samsung to court over our TV ($5000) as it failed only after 2.5yrs. They said I could pay to have it repaired which I refused and they tried to fix for free in the end without success. They offered me a pro rata replacement which I refused and so I took them to court. I beat them and they had to pay out for the total court costs and TV. This was in small claims court so no lawyers but I would think $18k would be considered normal court with Lawyers etc.

              Never be afraid to take the big players to court.
