Purchased in October last year? Never noticed the it wasn't installed? Where would the unit have been located if it was installed, I'm assuming probably under the bonnet?

I think you'd be wasting your time with this one... You're word against his, all he'd have to say was a mate upgraded his chip but didn't have an eBay account... Live and learn!

Worth a try though, if you're willing to put in the hard work

I think the legal avenue will be fruitless for the time and money involved. Frustrating I know. I love berniebgf's comment which would be a great thing to do just to give this snake the sh*ts. Or another way to get him back would be to fill a stinky filthy wheely bin full of water at night, lean it against his front timber door, knock then run. Your car parked around the corner of course. It would've been worth that snake steeling your chip for you to get even by doing something like that. It's really no different than him advertising it with near new mud terrain tyres and then swapping them over for road tyres and trying to convince you and or himself he took them off before you made your final offer. Fill his letterbox with 1 or 2 cans of Foam Fill ($10 a can from Bunnings) and hope he doesn't check it for 12 to 24 hrs until it's cured. It sprays out of the nossel super fast and expands to 3 times it's volume as it dries. You'll empty a can within 10 seconds. It dries to a rock hard foam and is very difficult to remove, even from a flat surface. Has to be sanded down or sawed off. Trying to remove it from the inside of a letterbox so mail can be inserted, impossible and priceless haha. Within hours it'd be forcing out through any opening and crevice of the letterbox it could find as it expands

I did chemistry in high school. The only thing I remember is how to build a unique device that mixes potassium permanganate with Glycerol. For the more innocent amongst us, these are the basic ingredients that have resulted in many an exploded letterbox.

Perhaps you should buy the unit from him and pay by cheque. Then cancel the cheque. You are perfectly within your righs because there is no law that requires you to pay for something twice!!!!

                            Well the update:

Left him alone after the phone call yesterday, it ended in him hanging up.
sent hime a few texts stating a few facts, nothing nasty, im not going there.....
spoke to police, if he's not denying it there may be a charge available.
Spoke to the justice department, they said best pay $37 take him to vcat, with the evidence I have he will loose, I will then have a judgement that is enforcable. If he doesnt pay I can step it up to the Magistates court at no cost to myself (more costs to him) the sherrif enforces that! Also if he doesnt show up it will be heard without him and the same outcome......
so does he want to deal with the stress?
take a day off work to go to vcat?
                            have to pay with costs?
possibly receive a summons in a few months?
1 or 2 or 3 days more in court depending on his plea?
a fine? or community work a reconrd? conviction?

or just do the right thing? bingo i recon.....???

                                Tuesday update:
The decision came Today not wednesday.
He has decided to provide the chip for pickup by its rightfull owner at his local post office.
Good outcome overall. Like I said earlier, he seemed fairly honest bloke, Just a shifty rip off!
