'Legal action' costs Brad a fortune each year... So many copies on the market. Some doing their own research and development an some riding on the back of Maxtrax's design.
You should have seen a copy we saw at SEMA 2011 in Vegas... sheez, they didn't even try to hide the fact that it was a direct rip off.
Brad has patents in AU an Patent Pending in the US so he's on top of the copies... he does appreciate any links to people selling ripoffs so if you don't think he would have seen the ones your talking about maybe email him some detail.

All the cheap "recovery tracks" I have seen on eBay, etc don't look anything like the Mk 2 MaxTrax, most look closer to the Mk 1. I guess if they aren't copying the MaxTrax shape then they're not impinging on Brad's copyright.

Yeah, Brad was releasing the mkII at SEMA in 2011 and it was the mkI they had copied.
I'm guessing here but I would think the patent still holds even if newer models are made... he would need new patents for each model as the design changes.

patents are virtually useless nowadays, think of how many items or appliances you use around the home that you see come out on tv and then suddenly appear on your local dollar shop shelves within weeks...

The small problem with patents is they are impossible to enforce in China. My limited experience with American patents is the willingness of parties to challenge them which is also very costly. For those old enough to have seen the movie "Breaker Morant" Rule 303 should be applied to any such low lifes. That said, I have got myself into hot water on the issue of Maxtrax before so enough said.

PS which side of the fence do I sit? look at my signature or my rig and its obvious.

I just am annoyed that retailers complain about shoppers hunting down the best deal on the net and then they rip off a great aussie brand.

those are a completely different design though, the concept is the same but the design is different.

Same as Nespresso, a million designs from the same thing, however the original designers still make money (they can afford to pay George Clooney), though they will always cry poor.

Suck it up and accept the way money is made nowadays as far as i am concerned.

The suck it up attitude deters people investing, and taking risks. Everyone will just sit back and wait for the other to invest in R&D and then pinch the seulting profits. Nothing fair in that no matter which way you look at it. The developer loses because it is not worth him taking on the risk, the customer loses (because the product never becomes available) and the little lazy F$%k that rips off the idea loses (thank God).

oh, not to get too morbid but our life expectancies will revert back to mid forties from the mid 80's, persons unfortunate enough to get diabetes, child hood cancers, lukemia, cervical cancer, and a myriad of other afflictions would as you say just have to suck it up too. You see pharmaceutical companies are not overly concerned with the betterment of the human race unless they receive a significant portion of the "betterment" and usually on an exclusive basis.

For a small operator enforcing patents is time consuming and costly process. It comes down to cost benefit, and I sympathise with Maxtrax in the difficulties in trying to protect their IP.

There's also two kinds of patents Utility (How it works) & Design (How it looks). eg Coca Cola couldn't patent the bottle, but they could patent the design of their bottle.
I'm not a lawyer but with Utility patents its about the 'claims of the product'. The inventor makes a claim about what the product does, and it must be new or distinctly different from others. (rotary vs piston engine for example) As these kinds of devices have been around for ever (My grandfather used a particularly lethal variety in the deserts during WW2 made of aluminium), they're not new therefore they're hard to obtain a utility patent for. However the design of them is unique. But Design patents are easily got around (add a hinge, or some ridges for example) and are only enforceable in the country of operation.

It's thanks to this site I purchased genuine Maxtrax. I originally thought they were shockingly overpriced...until I physically had them in my hand and could feel the weight and strength of them. I have never seen any of the competitors get close on the quality. I would go the Bunnings DIY route before I purchased one of the cheap sets.

From my research, there are lots of cheap ones and all seem rubbish... then there is a big jump in quality to the Treds brand, which do seem pretty good and I think they would do a job... then there is the next jump up to the Maxtrax. I have not seen anything better than the Maxtrax.

I do intend to buy a 2nd set... but I have other priorities to deal with first.

As Blue Box, I have been looking at recovery tracks for a while now, and after A LOT of looking around, chatting to a bunch of like-minded 4WD enthusiasts on the beaches of South East Queensland, I have settled on the best and plan on picking up my MaxTrax II ASAP. After seeing them in anger a couple of times without issue, as well as witnessing several of the "cheaper" knock-offs fail (snapped in half!), there is no descision to be made! Also feels good to be supporting our local companies that are support us and our lifestyles. Cheers...
