While the original copyright still belongs to the owner, the use of the image once posted to a forum may no longer require the permission of the copyright holder as 3rd party now has been granted permission to use the image. It may be the case that restricting the use of the image by some random person, once posted, is not as simple as the original copyright holder saying they don't want it used.

It's a grey area - and if lawyers are involved that can only mean $$$

A third party has exactly zero rights to take an image from this site and use it commercially without permission.

What a JERK!

Photo prado and MLC are correct and the image has been taken without permission.
I have been in this position before and came out quite financially rewarded, although it was the principle that mattered.

I suspect a similar resolve will pan out.

I am interested to see how this pans out, I know a guy who used 2 of my pictures and entered them in a calendar competition, I might sue his A$$

Like the ebay seller i contacted that is trading as holesalesuspension in the hope that he will be mistaken for us and snare some business.
I contacted him with no reply so far.

Speaking of eBay and jerks, I won an auction in November last year for a second hand bench grinder, I paid straight away and never received the item, the seller wouldn't answer my messages and eventually I got a refund through PayPal, naturally I left him negative feedback. Today I receive a series of abusive messages calling me all the names under the sun and culminating in the suggestion I should have sex with myself from the seller................ Plenty of Jerks in this world, if he didn't want negative feedback he should have sent me my item, its not my fault I got it on a low ball bid cause no one else was interested.

I have had enough of EBay too. They wanted me to prove I owned the vehicle! No problem until they said the South Australian Police had to ring them. Yes, ring them. Kind of bizarre! I suggested I would send them documentary evidence but that would not suffice. After phoning a friend that coincidently is a cop, he suggested in no uncertain terms that EBay may want to reconsider. I spoke to EBay this morning and escalated my complaint and suggested they revise either their practices and quoted the lovely Policeman's advice or revise their protectionist policies in favour of persons committing illegal actions. I expect results by 5PM tonight or will hand on the EBay approach to those that like to run with those stories, I mean issues.
