  • Unauthorised Repair.

I'm in a situation at the moment with a repairer, so I won't mention any names.

My vehicle is currently at a large service centre.
I was waiting to hear if warranty or part warranty would cover the repair.
Failing that, I was going to go the route of insurance. (its not crash damage. Its structural failure)
Failing that, I then needed a quote for the repair and decide what to do from there.

Warranty is no. But, without a quote and without authorisation from me, the service manager has gone ahead with the repair. I have contacted my insurance company, but I think they will say no as the repair has been done.

So, in the event that I'm stuck with the bill, what are my options given that I was not given a quote and the repair has been done without my say so?

    The bill is $2500.00

I know there are quite a few NSW tradies on here, so facts rather than opinions is what I'm after. I will also be contacting NSW Dept Fair Trading on Monday to get some advice.

Details, Beach - going to be all about the details.

Were you specific about when you dropped off the vehicle, that no repairs to be done unless authorised by you? Seems silly, since you dropped off to be repaired - but I have too been stung with this. I ended up only paying for what I wanted done.

Hopefully, they called a mobile - and you have an easy access record of when they called.

Did you sign a form authorising only the work done that had been requested? I know that when my cars go in for a service / repairs I know that I am only signing for the work to be done that is on the form. anything else does have to be authorised by you. I know it will be a tough one for you and seriously wish you all the best of luck. Dept of Fair Trading should be able to help out as you have said.

Specifically, I was waiting to hear if there was any possibility of a warranty claim. Failing that, insurance was the next option. Thats the conversation we had. At no point did I say go ahead regardless.

There is a brief email where I said I would come and see them. Again, nothing was authorised or quoted.

Nothing was signed. As I mentioned, its an unusual occurrence, so investigation was required before anything was to be done.

$2500 isn't something someone normally has in their back pocket for repairs... Every mechanic I've been to has told me that they'd let me know before any repairs were done so I was aware of the price and to make sure I wanted to go ahead.

You are in the clear then, it is in writing. Just check your sent items.

Even better as sent items lets you know it was sent, not received or read.

In Outlook use the options to tick the read receipt and received by the sender, that way you know it got there and also read by the recipient.

Yes, but read receipts outside of a Domain environment are hit and miss.

If no "delivery failure" messages are returned, it made it to the destination. Whether, as mentioned, it read or not is another matter.

also very true, fax would be the next best choice with a confirming phone call

                      Fax?

Spent the last 3 years removing them.

Email is enough for court - especially if one can show header information.

Not really, it only shows it was sent, it doesn't prove the recipient received and/or read the message.

Sorry, I meant to add that a call to the ISP to show routing/delivery status as well.

But yes, can't prove that someone read it, even more naughty if they deleted without reading.

You'll need more than a call to the recipients ISP for a legal hold, typically a warrant.

That would annoy the sh!t out of me on principal.
Simple, if you did not authorise the repair, you don't pay for it.

I suggest you speak to them, tell them how it is.
Chase the insurance & watever routes you might have.
If you get t covered, then they can get paid from insurance, if not, then you might find out if the charges for the repair are reasonable & pay or pay part, (good will gesture) I assume it would have needed to be done anyway.
