    You can't sell the car, he has the papers proving its his. As soon as you sell the car, you have basically broken the law. Take the money, if you have a notice of disposal, fill it in and send to RTA and then report the car as abandoned. Let the tow truck take it away, it's his problem now.

      Yes but the little tosser roped his details of the paper and left them in the car.
      To my understanding Pugaree has both the money and papers.

        No matter what, withdraw the money, move it to a different bank. Even though banks all cooperate etc, putting more roadblocks in is surely a good idea.

          Two weeks on and the saga still continues. I still have the car and the money.

          I received a letter in the post earlier this week from my bank asking me if I would like to reverse the bank transfer or if not, please provide a written explanation as to why. I have sent a letter back to the bank with my reasons for not authorising the reversal.

          I also tried to cancel the rego so that I could declare the car abandoned but ACT Rego wouldn't allow me to do as the rego formed part of the sale, fair enough I thought but they later called me to advise that I am able to cancel if I wish to. I have chosen not to at this stage, if he does try to take any legal action I don't want anything to hamper a finding in my favour.

          I have tried to contact him a few times again this week but that is the last I will try, as I expect that once he learns that I haven't authorised the reversal he'll be forced to take some sort of action, either legal or asking to come and collect his car. Stay tuned.

            Thanks for the update but Jeesus.. I would have thought it was all said and done. Ideally you need to get the car to his house as you don't want any finger pointing if the car gets damaged out the front of your house.

            I agree that once the money doesn't come back it will bring it to a head again. He should suck it up, take the car, sell it himself and learn from his mistake.

              This adolescence is such a tool. I was going to say at the start just give him a refund but he's really jerked you about. I bought a car as a kid, took it to my neighbour ( a mechanic), he just rolled about laughing as it was shot to pieces. Re advertised it and re sold same week to some other naive wipper snapper. Hope it turns out OK for you as you've done everything by the book!

                    Yeah, I don't have his address, it was on the Notice of Disposal that he destroyed, plus I don't want to touch the car at all. My obligation is to park it in a place where it isn't going to cause problems to anyone and is left locked and secure. I've parked it on my front nature strip, locked up and keys secure.

                      I'm betting that you will most likely end up with the cash & the car.

                      At a guess, I'd say he hasn't told his Mum that he has transferred the money into your account & won't come and pick the car up as she will then know.

                          If it's like SA. Call council and say it's dumped. They will sticker it, a few weeks later they will tow it to their holding yard. Put a public notice in the paper and ultimately it will become theirs and go up for auction..
                          I'd also be doing the rego transfer into his name with whatever details you have.
                          If you PM me a name and what/any details you have I can have a look for an address for you during the week.

                            I can't believe your worried about it. He ain't going to take any further action- it would cost him more to than he would recuperate. At some
                            Point he will want the car.. It's out the front and all his.

                              Ok, so received a letter in the post today, my little mate has raised a Civil Dispute Application with the Civil and Administrative Tribunal.

                              He states" I went to purchase a red Daimler car from (My Name). The car was not as specified by Michael and there was insufficient paperwork. He could not provide me with the cars registration papers. Due to these reasons, I did not want to buy the car and I wish to reclaim my deposit of $5000 from (My name).

                              I have just finished tidying up my notes that I have kept as this has progressed, thank god I was advised to do this at the start. I can't see that he has any case at all and all it is doing now is peeing me off. I do have his address now though.

                              I'll be seeing my solicitor on Wednesday and submitting whatever it is I have to submit.

                              I think his wording is interesting too, it wasn't a deposit, it was payment in full. He was also happy with the notice of disposal. I can't wait to see his face when I produce the imprint of the notice of disposal, perfectly matching the handwriting on tonight's paperwork.
