ACAT.... this is a simple breach of contract. Offer and acceptance and then an imbecile hanging on to mummies apron and wanting to reneg. Personally, I would be considering my options to take it the the Federal Circuit Court (old Magistrates Court)where there is common sense and real law. As the amount is less than $25,000 its no lawyers too.

After winning I would approach him to shake his hand and put a dummy in it saying "here buddy, you'll be ok"

MLC, you raise an interesting point, for the sake of a missed sale and potentially a delay in selling the car again is it worth spending all this time just to legally enforce the contract ? If the other party took the same approach I am sure they can also up the ante. At some point it becomes nonsensical and is just dick measuring.

If the case is cut and dry the tribunal will sort it out, otherwise my suggestion is to move on. Life is to short to waste time with wankers.

I hear you, but its 30 minutes in the FCC, it's he said, she said, here's the proof, here's the judgement. Still, courts can be scary if your lucky enough to avoid them most of the time.

2 guys agree to swap cars. They each do the transfer of registration. Neither car is inspected prior to the swap. All good for a couple of weeks until one of the cars craps itself. Now one of the guys wants his old car back. This is the sort of stuff that we have to put up with.

The problem is there are always at least 2 sides to each story - and each side thinks they are in the right. That's why there are Courts and/or tribunals who deal with these issues.

(PS: no reason to doubt the version given here, just stating the obvious above.)

The deal was done! There are so many silly people.
What's even sillier, courts & mediators do make mistakes & some of them are silly too they might feel sorry for the fool.

It will be Interesting, I hope a fair outcome is reached, that is he is ordered to remove the vehicle or its free to good home.
