Fencing contractor issue

    Maybe do it both ways to cover your arse.
    I only mentioned the rent link as i would have thought registered was the best option too.
    Only when told by the courthouse registered was not necessary.

    Either way it a buggar having to pursue any repairer for rectification work or refund.

      Hi guys, thanks for the feedback and advice. It's very much appreciated. Yeah he's got an ABN. He advertises online on The Home Improvement Pages, Aussieweb, Australiabiz and a fair few more that I found. He's got permanent adds in the local papers as well. As expected I didn't hear from him by 5pm Monday. So I called him 5 mins past. I called his home phone number which is also advertised. When he answered I mentioned who I was and my dilemma and asked if he forgot about me or if he doesn't read his text msgs. He acknowledged straight away that he knew who I was, but said he didn't know about my text msg which I sent him on the weekend. He said he doesn't read texts on his phone and gave half an explanation as to why which didn't really make sense. He'd be in his late 50s or early 60's, so I gave him the benefit of the doubt for that as some people that age aren't all that tech savvy. But I knew he'd know I wasn't dropping this as the neighbours said they were going to call him over the weekend to pass on my request as they also knew that me phoning him fell deaf ears. I just think thought I'd probably let it go if he never contacted me. I told him very clearly step by step how I wanted him to fix my fence and he agreed to and okayed everything which I mentioned (which he's also done in the past as well). I asked when he can do it and he said he'll come around on Saturday. I told him I'd give him my phone numbers because I wanted him to call a day or two prior so we'd have a little notice to move our horses from one paddock to another while the work was going on. This is where his dislexia was apparent. He wrote my number down with a pen and I got him to read my mobile number back to me and he had numbers jumbled around the wrong way over and over. I still don't think he got it in the end after me repeating it half a dozen times and him reading it back incorrectly each time. I then thought my home phone number would be easier for him.... Nope! He kept switching numbers around to what I gave him and I gave up after 7or 8 attempts. I'll call him tomorrow to follow up since the numbers he'll have for me will be incorrect. If the weather's fine and he doesn't turn up and I don't hear from him, I'll call him to tell him if he doesn't come straight away I'm taking the matter further with the ACCC. I'll make the neighbours aware of what's going on so they've got the full story.

      We've reassured the neighbours there's no problem between them and us. Our problems is with their fencer. So no issue there.

        Hope it all goes well for you Brett

        On jobs like that with their stuff ups, I normally fix them myself so I know it is done right.
        If they damage the materials, that is another matter.

        Name and shame is the way to go. He has had plenty of time to fix it, if he intended to fix it.
        All the best in your en-devours to get it back to the state it was in.
        Him reading the numbers back might just have been a stall tactic.
        If someone wanted a job done for payment, would he have got the numbers wrong. ??
        Maybe I am too cynical. (Hope that is spelt right)

          You also have the option of reviewing his work on google and facebook etc.. be truthful, it sounds like the reviews wont be that good anyway.
          If he doesn't turn up saturday, Id read him the riot act that you are now having a contractor repair it and will be sending him a civil claim for the costs plus your costs incurred.

            The fencer didn't turn up Saturday. I phoned him at 3pm very annoyed asking him where he was. He said he was in Brisbane. He said he'd come on Sunday (today). I said is it going to be like every other time where he says he's coming he's coming and not show up. He said, no no I'll be there. I told him Ive been extremely patient with him so far and have had a gut full of him lying to me by saying over and over that he'd be coming and never call or turn up. And to be so dodgy, dishonest and gutless in the way he goes about things. I said, "Do you know how frustrated and angry I am with you now?" I said if you don't turn up on Sunday I'm going to get the ball rolling with taking this matter further on Monday. 11am now and a no show. He's not coming. So looks like I have to go down the painful road of pursuing this and if I'm actually legally able to get another contractor to fix the fence and then take him to court to recover my costs.
            The weirdest thing is he never once challenged me or disputed anything I ever said to him when trying to get him back to fix it. He was always quick to say he'll come tomorrow or next week. This all began back in November 2015. He first fixed it then after the Cnr post was initially on a lean pulling my gate tight.

            Thanks guys for all your comments. I'll look into each suggestion offered and take some action tomorrow. I'll keep you updated.

            I guess I can name and shame this fencer now since he's definitely not going to fix my fence and basically because I want to warn other people from making a mistake and using this guy. And because it's the truth.

            Sunday 5pm update. I phoned the fencer Darryl and upon me threatening to take this further for the 4th or 5th time now, he said he'd be straight out. He came out and had a look. At first he suggested to fix it the easy way but I said no to that and told him (again) exactly how I wanted it done and he agreed. He said he'll come back tomorrow afternoon (Monday) to begin the work. Maybe he finally got the hint I wasn't letting this go. He was nothing but friendly when he came out so I don't know what his caper is. Just lazy I guess.

              Document the damage with photographs. Use a phone so date stamp is accessible.
              You are legally in your right to have it fixed by some one else. You will have to pay them. Have them give a letter headed write up of the fault. The causes and the rectification needed.
              Then launch a civil claim against him to recoup any monies you've lost. + costs.
              I'd also be leaving poor reviews for him after (if) job gets done..

                How much is the repair bill? Then taking him to court and feeding legal eagles is throwing good money after bad he can tell your legal eagle to where to go and drag it out for quiet a while who could be bothered with that really?
                Shawly the repair bill wont go over $1k the last legal turn out I spoke to cost me over $500 to sit in his office and talk for 1/2 hour he might of written a letter or 2 after that point being they aren't cheap.
                I got myself some Big Horn Maxxis and was telling my landrover lover mate he said what size did you get I told him 265/75/16 he said I didn't know they came that small.

                  A civil claim can easily be done without using a lawyer.

                  At $1000 an hour your getting ripped off by about $6-750.00.. Id be changing lawyers.
