  • Outcome of DPF Class Action (Court Action)

    I heard a short while ago about the outcome of the class action. Owners of diesel Prados manufactured between 2015 and 2020 could receive significant compensation. Refer to the artical below as a starter.

    I wonder if Toyota will appeal prolonging the process and making even more money for the lawyers.

        I doubt if it will ever occur - lots of these cases may win at first , but there is always a high chance of the decision being reversed upon appeal

            I haven’t verified it, but a car nut at work told me last week before I even read this that $7,000 will be awarded to each affected Toyota owner as part of the class action.
            2005 120 series V6 Grande, 2 inch susp lift (King/EFS combo), 32 inch MT’s, Safari Snorkel, rear diff lock, breathers, Light Force spotlights, UHF, dual batteries.

              Its more "IF" Toyota payout compensation, that the compensation figure would be around $7,474.59 to each affected customer. This figure is variable upon many factors however.

              It is calculated as the vehicles fitted with a DPF are worth around 17.5% less than ones without, hence the random $$ figure.

                Likely affected owners would be a small subset of the 2016-2018 builds, who are motivated enough.
                Minus the eminently modest fees of class action lawyers and their financiers.

                  I'm in that category: 2016 GX delivered January 2017. I've missed four days work because I didn't have a work vehicle - one for the white smoke clean-out and reprogram and three for the replacement of all the DPF and 5th injector components. And when the time comes to eventually sell the Prado, I'm too honest to lie about the car's history, if asked.

                  Now, that is something I don't see in the same sentence very often: "modest fees" and "lawyers"!

                    i believe the fees for this type of class action are in the order of 30 -35%.

                      I have a 2019 Prado (July) so it is within the time line nominated for the faulty DPFs. I had heard about the class action but had not been following issues strongly, as I was lead to believe that Toyota had sorted the matter before I purchased mine. Certainly there was plenty of DPF issues being posted before that time. Also to date, I have not perceived any DPF issues. Regular burns, no white smoke, no excess fuel use. The vehicle has just done 70,000km and booked for its service. Most of the driving is highway driving and with some caravan towing. For my vehicle, the DPF performance is like the performance of the newer DPF action as described in one of the recent forum posts.

                      Today, I received a notice from the law firm handling the case about registration for a compensation payment. For me, as I stated earlier, no perceived problems so far, but as indicated within the notice from the law firm, some of the compensation is for a devaluation of the vehicle because of the DPF problems. Has the vehicle, as group, been devalued because of the DPF problems for some vehicles?

                      So anyone else in a similar position to me? I am thinking that there would be quite a few.
                      Does anyone know if they are compensating only those owners who had their vehicle worked on for DPF problems?

                        My Prado also falls into the "affected" vehicles and was contacted some time ago re the class action.
                        In regards to the devaluation of our vehicles looking at sales prices over the previous 18 months or so hard to see any devaluation at all

                          Toyota is appealing the outcome, and the way Prado's and Hilux's (or any car for that matter) have been selling at huge price increases, means that it wont be too hard for Toyota to prove they have not devalued at all. Be interesting to see what happens then.

                            I found out today that owners of affected vehicles need to register their personal details and their vehicle's details with Deloitte in order to be considered for compensation. If you are not registered for compensation, you will not receive it! Start by going to the website www.toyotaclassaction.deloitte.com.au and following the registration link. The return code email can take a considerable time to be sent to you - keep your browser with the registration page open so that you can insert the code correctly. Further information can be seen on www.comcourts.gov.au/file/Federal/P/NSD1210/2019/actions The case ID is NSD1210/2019.

                            If you think you are eligable, get onto it promptly!

                              As part of the registration information that is required, you need to attach something to the electronic registration to show proof of ownership and the purchase price of the vehicle, so electronic copies of that documentation needs be ready for when you enter the registration website.
