    Yep there's those legal terms that may be the only levers to make the dealer pay out as they should.
    I haven't talked to anyone from dealership today, I would have thought someone would call me and play suck up.
    bloody amazing, now I look at it why did I think it was a good idea to have them service it....#### is right it just seemed the natural thing to do for best for the car?.....WHAT WAS I THINKING.......

      I would insist on or take a sample in a few thousand k's and have the oil tested ' oil sampling' test for particles etc the oil samplers know what they are looking at ... it will tell you exactly the condition of the engine. Have that done for the next 10 - 20k and if its clear through that itll be fine if it isnt itll show up in the first test or two i can guarantee that

            I shouldn't have to put up with that level of stress and worry over IF my new(ish) car has problems like that. Not on when you pay through the nose for *NEW*

              My 2 bobs worth, I would not jump in with lawyers and threats at this early stage, keep that powder dry. Just do your best to say clearly that you expect a new engine or a 300,000km gold plated warranty or whatever you feel is right. Try and get on side with the service boss if at all possible but don't let them walk all over you either. They would have insurance as already stated so try not to loose too much sleep over it either. I would suggest taking someone with you to avoid any sense of power imbalance and to witness what is said. If you get nowhere then talk to your lawyer but that will cost you!

                Just thinking the dealer may want you to just drive it until it has an engine failure under warranty so Toyota Australia pay out rather than him? But who would want to be on tender hooks for the next 3 years hoping the engine was going to die at some convenient time!

                  You must feel really cheated, doing the right thing only to be duded by the Toyota Service people. I hope you eventually get a new engine out of them. There is a lesson here in Eric's bad fortune and that is to "always check the oil level every time after someone else does a oil change for you".

                  Some of my rellies had the exact same problem after a service (not Toyota) in their Kluger and it resulted in a complete engine rebuild, of which they had to pay half as the service mob refused to accept full liability. This process took about 6 months.

                  They drove home after the service, limped onto their driveway, checked the oil (oil light was starting to blink) and nothing!!!

                  I always check the oil before I start the car after a service, get a few funny looks and questions but when I explain why I'm usually told "Check it Check it"

                    Breach of professional duty, negligence etc etc will trigger this dealers motor trade policy.
                    nope the work shop paid out of there own pocket insurance wouldn't cover it i think he told me 8k for a long motor by memory.

                      For most of those companies they would rather pay a bill like that then claim on their insurance as excess and then increased premiums aren't worth it. Unless it's a decently large bill (like a whole car!)

                        I meant good insurer that they settled the claim in a week or so, the policy coverage is a given - perhaps he needs to have a good talk to his broker.

                          More likely they have a large deductible that keeps the premium low. Many companies self insure for small claims.
                          Unfortunately you have had a shit experience but I'll fall off my chair if you get more than a letter recognizing that it happened given you grounds to appeal should something happen in the future. Even if they agree to pull down and rebuild, would you trust them to do it ?

                              Thank you all for the comments and advice,it has been such a good source of unbiased information for me. The dealer has left a message on my phone saying car has had numerous tests and is ready to go. I will be contacting fair trading tomorrow to lodge the complaint before I go to see them, and will now be seeing what the dealer has got to say... I don't believe I will be accepting their assessment of the engine as being ok and will probably be going down the long hard road of trying to have engine replaced or having an extended warranty in writing... As far as I am concerned there is too much chance there is damage that cannot be seen at the moment or will appear down the track....again thanks to all I will keep posting.
