Please collect the car within 7 days from receipt of this letter.

I would also provide contact details to arrange pick up.

IMO by doing this I think it would greatly improve your position if things deteriorate as you have kept communication open and acknowledged receipt of payment.
This is a good idea ^

    IMO,
We can all see what's happened here The new owners probably don't realise they have no chance of a refund.
If they were to attempt to suuuuuuuuuu! Lol..... Well that would cost more than the vehicle. Small claims? They have nothing for it?
Report it to the police, it's an abandoned vehicle.
They will have to contact him to remove it. If at that time he doesn't want it, you have done the right thing & storage fees commence.
$100 a day there I believe? Please advise him of your rates as soon as he is requested to pick it up. Remind him you will own it again very soon.
Also insist when he returns to pick up, fully complete the transfer forms so that he is not charged by the police.
    He will! Maybe!

    Or

Check over the vehicle, offer refund subtract fee? $1000? Get it in writing, like really! No$$$ till its legit!
    The end? Maybe!

I'd expect he realises he needs to pick it up over the next few days.

Don't waste $$$$ going to a lawyer. You have done everything right citizen.

Meh don't worry about the transfer form. Cancel the rego and say it was a sale of an unregistered vehicle. No need for transfer forms.

So a couple of suggestions above got me thinking. He destroyed the notice of disposal doc but he didn't destroy the page we were leaning on when we filled out the form. A makeup brush and some of my daughters make up powder and we have a perfect imprint of all his details.

          It's sucks to be him.

At the back of the rego papers, isn't there a section called Notice of Disposal where both party's details are recorded and you keep that section to hand into the transport department?

10 points for creativity there. I like it. Just remember to be firm but polite. At least to begin with. I'm sure you'll come to a sensible resolution

Yeah and I didn't realise that he took it on the Friday night and he was returning it to me the next day, when things didn't go as he planned he tore the section off and ran off with it.

Been nothing but polite, made sure of that right from the beginning, didn't want anything that could came back and bite me. Now that I have his money, I'm a little less stressed about it all, I'll give him a day or two to grow some plums and hopefully come and talk to me and pick up the car.

Oh bugger. I actually did the same thing and handed the buyer the wrong section. Rang him up as soon as I realised and he drove back to swap it.

Sounds like you are in a good position. Would it be with delivering it to him?

Another two days on and despite numerous attempts to contact him by phone (he hung up on me), text and email, I have heard nothing. I have moved the car off my property onto the front nature strip and have locked it up. I have suggested to him that if he doesn't want to talk to me, to get his Mum or someone else to, that was yesterday.

I have also spoken to a solicitor and given my version of events and according to her, I have done everything correctly. One thing I found interesting was that text messages were the only means of communications I had to try to contact him with, the reason being is that is how we had communicated before this went down and it is reasonable to expect that he is still contactable that way. I gave him the benefit of the doubt and also sent an email. A registered letter is not required. I also should not front up to his house.

Anyhow, I'll wait a few more days and see what happens.

You've got the cash and the car! Clearly the upper hand. My guess would be he is trying to get his money transfer reversed through his bank (good luck trying to pull the wool over the eyes of a bank). When he realises he can't get it back from the bank and can't get it from you he will suddenly decide he wants the car. May as well get something for your money right....

How long do you have to hold the car before you can resell it or have it towed/disposed of? Have you found what your obligation there is?

I would not bother with lawyers, but its good that you have their advice.
You have the money so thats easy.
Ask him if he wants you to resell it for him at whatever price and refund the difference less your expenses.
If you sell it for $2000 and it cost you $200 in costs then pass on the $1800.
                            Fairest you can be.
If he wants more then he can collect it and sell it himself.
Your not obliged to sell it for $5000 and give him it all back.
Good luck and will be following.

x2 - especially given you've been paid the money for the car.
