    A mate was caught doing the wrong thing had the mobile phone against his ear whilst driving , and sure enough he was pulled over . He admitted to the police officer that he was doing the wrong thing but pleaded if he could not be charged and get off with a warning as this will make him lose his license and result in loosing his job. The police officer said in two hours time he will be back at the police station and he will not issue a fine if he received a receipt to prove that a $100.00 donation was made at the local childrens hospital --- now that is sending the revenue in the rite direction

        very interesting , if the officer was a victorian cop he would have gotten the sack by now , it seems that any kind of common sense or discretion is swiftly looked down upon and reprimanded . there was a copper only last year in vic that was found out to be not believing in speeding fines, he had a lapse in judgment and realised that they were for raising revenue , he was cautioning drivers and wavering the fines. he was subsequently stood down and taken to court for obscuring the course of justice .

          Unfortunately in NSW and probably in most states the police have vehicle mounted video which switches on when they pull over an offender, the other device used is a voice recorder when speaking to the offender and the offender should be cautioned that they will be both visually and voice recorded.

          This makes it very difficult for those officers to use their discretion when dealing with some offences, the "big brother" state is keeping an eye on those that keep an eye on us. No I am not a police officer but grew up in a police family and still have friends in the job! Most of these guys are really good blokes and would use their discretion to both improve their reputation i.e. the police force and assit the general public to be more considerate when there has been some common sense prevail!

          These guys are working within some pretty strict boundaries and we as the public forget that they are human beings who are doing a job just like most of us.

          You guys who have grown up with family in the mines or who work in the mines will appreciate that your family will hear things on the news and wonder whether that was you and if you are going to return home at the end of the shift! That was how my mother and siblings often thought when we heard of things that had happened in the local area and whether that was Dad or one of your mates!

          There is no respect for the police from the public and this comes from the fact that the laws do not support policing so when offenders are brought before the courts offenders get off with a slap on the wrist and then laugh at the police because they know nothing will happen to them the next time. It really makes you feel good about the job you do!

          End of rant!! But good on the guy that suggested the donation a win win on both accounts!

            Good on the officer for common sense, the guy on the phone however......... if he is that close to loosing his liscense and his job depends on having one then he isn't real bright. I would feel no sympathy for him if the copper threw the book at him.

                ''There is no respect for the police from the public"" so true John but I wouldnt say everyone, certain dead beats and some known other breeds have no respect what so ever. I have/had family also in the force and I wouldnt do their job having to put up with ass holes most of the time, and its generally these people who will call them when they need help. The law is a joke in most ways not just including for offenders of crime, wife and I have a lot to do with DOCS, dont get me started on the low life oxygen wasting scum (wont call them dogs) who touch kids in one way or another, people blame docs for a lot of the issue, believe me alot is the court system, not the judges fault they have to go by the law, I could spend all day filling people in on what my wife and I have heard and seen (we are foster carers) Anyway good on the cop and hope he didnt/doesnt get in any form of trouble for doing what he did...........Cheers Steve

                  May have something to do with the industrial action in NSW the cops are taking, ie no booking for minor offenses etc.

                    Have to agree with AJ120 on this one. Yes it was a kind thing the police officer has done but has the driver learnt anything. As has been said, if he is that close to loosing his liecence and then talks on mobile while driving, as far as I am concerned he has not learnt his leason from the other times he has lost points.
                    I see so many people talking on mobiles during the day and yet nothing ever seems to be done, even though the ads on tv say they are policing it.
                    Just gets me going, sorry for the rant.

                      All sounds good, except the ratbags ruin it for everyone. The cops have been caught before, surprised he left himself open to this, must be a trusting fella.

                      How it goes is, ratbag agrees to the 'deal' but doesn't make the donation and doesn't pay the fine, challenges it in court. Tells the magistrate that the copper offered the donation deal instead of a fine. Copper looks bad, magistrate throws the case out, everyone loses.

                      Cops have their hands tied.

                        Seriously, it amazes me how many professional drivers (delivery drivers, couriers, etc...) don't just buy a hands free!!

                          Point taken and agreed on all comments guys! Yes, the officer has left himself open in a lot of ways for not giving the infringement notice and taking his alternative management path.

                          AJ120, I would not have had any sympathy for the driver talking on his phone either, it was stupid and is a stupid thing to do but there are probably not many of us that can say we haven't done it- therefore lucky to not be caught!

                          SteveM, I work in health and know where you are coming from, I regularly walk through the hospital and mutter to myself "they walk among us!" Yes they are also the one's that expect the most from the medical and nursing staff even after being the most threatening and abusive.

                          Snaga, buying a handsfree would certainly save a lot of issues but there are always going to be idiots regardless of whether they are using handfree or not that will have a lapse in concentration and end up in a collision.

                          Better training for drivers may be an answer, we use simulation training in health which has been adapted from the airline industry, it is all about reducing risk, maybe this was what the original plan from the officer was, reduce the risk by allowing the individual to be able to maintain his livelihood but still cause a bit of pain in the hip pocket with the money going to a suitable cause rather than Gov't revenue!

                            When I was young we lived in a small coastal town and the Police were to be respected, they had the opportunity to make discretionary decisions, e.g. 6 teenagers caught doing naughty things with cars, local Sargeant walks them down the main street in full view of all the locals back to the station (a few well placed size 10's on the way as well) all spent the night at the "Blue Light Motel" with the parents called at 9.00pm and told to come and pick their sons up at 9.00am next morning.

                            No fines, banned from the town centre for one month, just 6 s*#t scared blokes waiting for their dads to pick them up in the morning. I know for a fact that these blokes didn't end up in jail or doing the wrong thing again

                            As said unfortunately the Police are now in a position where "community policing" is now not an option as kids are brought up with the mantra that they "have rights" and know that they'll get off lightly.

                            I agree with being fined for doing things that are dangerous, but also agree that the fine should go to a worthwhile purpose or be negated with some form of community service as the alternative, my 2c worth.

                              Its good to see a cop with common sense but proof of handsfree purchase would have made more sense....It sounds like only time stands between your mate loosing his licence and job anyway he clearly hasn't learned.
