I have taken the matter up with my local minister as I dont believe an area supervisor will follow up quite as well. The VIS has also lodged a complaint with the officers station manager in regards to the incorrect defect and the waste of my/their time. Albeit yes, I did have illegal tint that was not originally noticed.
That's quite interesting. Mine is a lease vehicle. When I selected it I picked the "Darkest Legal Tint" from the menu and they tinted all windows (and quite dark). According to Toyota that is legal. So if it not, who is responsible to get it fixed? Me or the Toyota dealer that tinted the windows before registration?

      Re: Defected....

I got done in my old VS commodore by some board cops in the front of my old work in Emerald in Victoria one night. They followed me out of work down the road 50 meters then I seen the lights here we go. They proceded to ask the usual question's "have you had a drink sir " NO " where have you been tonight" WORK " where do you work" I'm the head chef at the pub you pulled me up in front of " ohh" . The reason why we pulled you up for is for a safety Inspection, While one was waiting for the breatho reading the other one was going over the car. They got me for empty windscreen washer bottle, one of the rear reflectors was shinning a bit more white than the other (common commodore problem) and a dim parker light. Next thing I knew I had a nice yellow sticker on my windscreen and they followed me back to work to park it for a night. It cost me more in a cab home than what it did to fix those defects.

If it has privacy glass then any tint (bar clear UV film ) is illegal.

The supplying dealer would be liable.

Bureaucracy gone mad. I believe all headlights (spotlights including) come in pairs. Therefore it is expected that you have even number lighting. The same rule applies to QLD registered vehicles.
well sort of, in qld you can have 2 or more additional 'headlights'' providing they are fitted in pairs, so theoretically you can have 2, 4, 6, 8....102..........but not 3

Maximum number of lights illuminated at one time is 6. But must be in pairs.

                Re: Defected....

                Hi Guys,

Just to clear up this whole window tint/privacy glass issue. The ADR's only cover window films. Privacy glass or "body tinted" glass that is fitted factory to window positions rearward of driver to many toyota's, subaru's, etc are perfectly legal as its not a film, with many having a light transmitancy of around 20%. Think about it, do you really think that a manufacture that spends billions developing a vehicle to comply with our stringent ADR's would stuff up on this???? This is also why the front 2 windows level with driver are always standard/un-tinted. (in SA) With film tint, as of 1st jan all side and rear windows must have a min light transmitancy of 35%. Before 1st of jan it was 70% on windows level with driver and all others rearward of driver 35%, so just be glad this has changed.

                Hope this helps.

                Cheers

                  Re: Defected....

Tint will be going back on, last few days has seen me sunburnt already from lack of tint whilst driving around. My view is that if it helps alleviate skin cancer then I will have it. If I get defected again, too bad.. I wear it again.
Just for interests sake...did you know when you are burnt through the window of the car, it's not actually sunburn? Glass passes very little UV and what you're getting is actually a radiation burn (heat). What the glass may do is focus the light down onto your skin, creating more heat, thus a quicker burn (big magnifying glass). The % of tint will inhibit the amount you get burnt but wont actually stop any skin cancer you might get (from true sunburn cases). The "UV" grade they put on tints is simply a marketing ploy. Yes it does cut down UV, but that UV will be almost completely cut by the glass when it hits the window anyway

Sorry...the cops aren't up for liability when you get melanoma :?

Regardless of this, the fact that you tried to do the right thing and got a defect notice regardless pretty much sums up the way the system works. We need more genuine (read actually concerned for safety) cops setting the standard.
                  Cheers - Phil Taylor

                      Re: Defected....

My comment wasn't in relation to the laws as the standard but as to how they're enforced or not: as per the examples in this thread.
I also wasn't saying that all cops are out to get people for defects - but is is clear there are those who need to get a quota and will seek out a modified vehicle to fill that quota.
If the constabulary were to encourage a reasonable attitude at all times and reprimand those who don't do the right thing..we'd all (bar those who actually want to cause a problem) be happy with them.
Then again...we're not in a perfect world.

We are actually no longer able to get tint fitted to our government vehicles. So, it can't be an OSh issue not to have tint. They will gladly supply long-sleeved shirts, hats and sun-screen.

In over 20 years of policing... I've never seen or been instructed to obtain a quota. It's an urban myth perpetuated normally by people who want to believe something other than the truth - that they got caught doing something wrong.

Fair comment - but it isn't a perfect world. And just like any service delivery business - there are some employees that provide an outstanding service which exceeds expectations... while there are others that just give the business a bad name.

That's good to know and I stand corrected then - sorry I was one of those to assume :?

How come incidents like this occur then? It does seem that at times people may be checked for one thing and if they end up clear, there will almost be a hunt for things until something is found.

I remember an incident 7 years ago where I got out of bed, went straight to the shop to get milk looking very ordinary (not that that's too odd  ) and was pulled over for a random breath test - was told this was all they were after and as I was 0.000 they then went over the car and finally, (although possibly arguable) picked on my number plate for being discoloured. Luckily for me I was moving to Tas the week after so they never bothered to book me.

Is there any requirement on police to prove they've been booking enough (not necessarily a quota as such, but possibly benefits for doing a good job..)? Or is this not something you're allowed to talk about?

Not trying to pick at police - obviously very needed, and do more good then harm for the most part. Just generally interested and don't understand why TP got the absolute fine tooth comb..

...TP, maybe you were looking extremely rough that day

Rumble11...lol@the example of defective just in case we didn't understand

Simple - like I said before - there are those that know when to enforce and when to relax the letter of the law, and there are those that don't. In every job, there are employees that provide excellent service and are great ambassadors, then there's those that are the opposite. Police officers are ordinary people and are representative of their community. Like every community, there's role models, under performers, troublemakers and good samaratins. But don't tarnish the entire group for the sake of a few. If you receive poor service, you have a right to complain and put your case across.

At the end of the day, it doesn't matter how closely a police officer examines your vehicle or what questions they ask. If you haven't breached a law or done anything wrong, then you shouldn't have anything to fear. If a police officer is over zealous, then report the incident to a senior manager for review. But in many cases, the reaction of the person and their responses to the police officer's questions are such that they raise suspicion by their conduct and quickly cause the police officers to lose any empathy or desire to exercise discretion.

There are plenty of performance measures to identify the effectiveness of police. The numbers of tickets issued does not necessarily indicate anything and might actually be an indicator of questionable behaviour. Continuous complaints for being over zealous, unprofessional or failing to exercise proper discretion would be good measures of poor service.

A number of years ago I did a training course conducted at the police accadamy, and run by the police there.

The sargent in charge of the course told us one day that he could always find an offence to book anyone for if he tried. We all broke some law every day when driving.
