    The ADR's are breached by some new vehicles tint, but are overlooked as thats how they are produced.

    I have taken the matter up with my local minister as I dont believe an area supervisor will follow up quite as well. The VIS has also lodged a complaint with the officers station manager in regards to the incorrect defect and the waste of my/their time. Albeit yes, I did have illegal tint that was not originally noticed.

      Re the tint, my understanding is that if it is privacy glass, that being actual tint through the glass not an applied film, and that privacy glass is a factory standard then the privacy glass is OK as it has been accepted with overall vehicle compliance.

      The issue arises when one either applies tint to the privacy glass or goes too dark on standard glass with a film tint.

      I have a mate who works for a secondhand 4WD sales yard & he frequently takes interstate vehicles to Regency for checking to get registered here & is always arguing re the privacy glass & film tint differences. He has been made to take off 35% film tint to front side windows when the rear windows are already darker but privacy glass.

        One has to wonder about the intent of the ADR tint specs for the rear windows. Especially given there are many work-vans have no rear windows at all - effectively 100% block-out. Really, why should anyone care what level of tint is on the rear windows :?:

          It is to protect the boy & girls in blue...so they can see what is going on inside the vehicle before they rock up to the window. :shock: Yes you are right you cannot see inside a panel van with no windows and you would use a differnet approach if you suspected something was not right and order them out of the vehcile so you could see what is going on. :roll: Not a memeber of the blue crew but know how it works and if given a little for thought to it...it makes sense. If your life depended on being able to see what was in the vehicle ahead of you when you pulled them over would you not want that advantage? I would love to have my window darker...and have been caught in the USA with it illegal and got pulled over right after a shooting of a memeber of the blue crew. Had to go to court and prove it had been removed after they made me take it off right then and there. I understood why and complied...not happy but understood ops:

              So the defect notice was partially justified then and you coughed to knowing that parts of your vehicle were non-compliant.

              What's the fuss then? You take the risk, cop the attention if you get sprung.

              Honestly, who can put their hand up and say that they would know every single ADR, every regulation, every standard and every act applicable to motor vehicles? Just try searching on the various DoTaRS sites and have a look at all the stuff relevant to standards and regulations. So don't expect the average copper to know them all either!

              I know my Cobra would not pass the current noise level tests for exhaust compliance. As the inspector told me when I drove away from the pits; "You drive it and you take the risk that you'll get pulled over for being too loud." So I drove away and 10 years later I'm still driving the beast with 5inch sidepipes and no mufflers!

                Respectfully, I must disagree. If traffic police are out there writing out defect notices for non-compliance against design regulations and standards, they need to be fully aware of said regulations and standards. My opinion is the law cannot be applied properly if those attempting to do so are umming and ahhing about the regulations they are attempting to enforce. There may well be a plethora of design regulations to enforce, but as in any profession, you know your business or you get run out of town. If police cannot commit each regulation to memory then those out and about need a simple way to check the design regulations fully before issuing a defect notice, costing the owner time and money. This haphazard way of enforcing regulations is inefficient and a waste of time and resources, for police and the public.

                That said, people with illegal modifications need to cop it sweet when caught out. I fully agree.

                Just my opinion in the interests of a friendly debate! :P

                  End of the day if the cops pulled you over with intention of giving a defect notice they will . If you drove a brand new vehicle out of the car yard with 300 metres on the odometer and they decided to give you a defect notice they will make some bulls-- to place a defect notice . I drove a vehicle out of the pits after having a canary removed couple of hundred meters down the road and sure enough I had onther slapped on the window so I turned the vehicle around drove in through the out door and showed the bloke that inspected the vehicle , he was not impressed contacted the cops that placed the notice whilst I was there and let them have it .

                    If you have a complaint with police, make it to the police. There are systems in place to deal with this despite what others might think. If the circumstances that you describe are accurate, then the police have not acted rightly and should be called to account to remedy the situation. Like any service agency, mistakes are made and there are some employees who provide less than satisfactory service. The only way to identify and deal with this is by reporting these incidents for appropriate sanction. But, like what was said before, if you know you're bending the rules, don't complain when you eventually caught by police. If you take a risk, there's always a chance it'll be realised.

                        Actually if you read, I was complaining about going to the trouble of getting engineering and Dept of Transport compliance on my suspension lift & Tyres, which I was then defected for.... Cop was wrong..

                        Yes, I had HID and also Darker than allowable tint. I wore that and had to remove said items, I dont have a problem with that..

                        Tint will be going back on, last few days has seen me sunburnt already from lack of tint whilst driving around. My view is that if it helps alleviate skin cancer then I will have it. If I get defected again, too bad.. I wear it again.

                        The main point is , I was pulled over for larger than normal tyres (That ARE legal due to the steps I took).. Said cop is in the shit for defecting an undefectable item... Total waste of my time, and the VIS time..
                        Now if he had defected me for having HID alone or tint (which he missed) then so be it.. But to piss me around for doing the right thing with engineers and the Govt is just bullshit.

                        As a note, when I drove past this cop he was slapping the Yellow on a 2009 BMW with 20" rims. This vehicle was also at Regaency when I went there, Driver was Spewin!!! He had also had the wheels legalised (same rolling dimaeter as the originals & Track). He didnt even have to go over the pits!! Said cop is getting a talking to over that one as well.

                        As they say, there was a blitz on that weekend and Plod obviously needed his quota!

                          That is what was done it was reported to the appropriate authorities in WA the inspections are done by employees of the lisencing dept where the car was inspected . And no rules were bent

                            Maybe we could transfer that particular copper out here. He would have a ton of work issuing defects for:
                            Vehicles being driven with no tyres.
                            Vehicles with no windows - none whatsoever.
                            Vehicles without roofs - been rolled, cut roof off so passengers can travel in car.
                            Vehicles with missing doors, missing bonnets, missing guards.
                            Vehicles missing lights, seatbelts, instruments.
                            Unregistered vehicles, unlicenced and/or suspended drivers.
                            Vehicles with 3 times as many passengers as there are seats.

                            DPI went all the way out to the lands to give them all licences so that they could then legally drive into town, get pissed and lose their licences!

                            Oh wait a minute, that would be racist wouldn't it.

                                Qld Transport and Main Roads has an Indigenous Licencing Program which does a similar thing. I believe that the goal is that we should not discriminate against those who are located in a remote site and unable to drive to a licence issuing centre because they don't have a licence.

                                I believe from talking to a number of the remote folks from QPS that the result is pretty much as you describe it.
